TrueTandem Privacy Policy

At TrueTandem, our priority is being a reliable partner and your privacy is of paramount importance to us. We are committed to protecting and respecting your personal data. This Privacy Policy is intended to explain how we collect and manage personal data from users of any of Azure Marketplace offerings or applications “App”). IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT DOWNLOAD OR USE THE OFFERING OR APP FROM THE AZURE MARKETPLACE.
We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the App after the date such revised Privacy Policy is posted.
Section 1. What data do we collect?
1.1 “Personal Information”
When registering to use the App, using the App or otherwise interacting with us regarding the App, users may provide, and we may collect, “personal information.” If users choose to provide such information to TrueTandem, whether through the App or by other means, TrueTandem may collect, use, disclose and process such personal information in accordance with this Privacy Policy.
“Personal information” (also referred to as “personal data”) is information or data that can be used to identify an individual and may include your name, title, mailing address, e-mail address, phone number, identification number (such as a driver’s license number), date of birth or image. Personal information may also include device identifiers, data and telemetry (such as IP addresses) when such data is linked to a specific device and person.
1.2 Personal Data Concerned
We collect personal data only to the extent necessary to ensure that you can access and use the App.
In order to use the App, a user must first complete a registration form. During registration, a user is required to give certain information (such as name, phone number and/or email address). Additionally, we may collect and store personal data that a user chooses to provide to us, at their sole discretion, without us requiring them to do so. This may occur, for example, when a user discloses certain personal data to us when contacting us or when choosing to store certain personal data in the App as part of the use of such product.
We also track, collect and analyze usage data within the App.
Section 2. How do we collect, use and disclose personal information?
2.1 Interacting with TrueTandem
Most of the personal data we collect is provided to us voluntarily. We collect personal information when you:
- register online or order any of our products, including the App
- voluntarily complete a customer survey or provide feedback on any of our message boards or via email
- use the App
The personal information collected by TrueTandem may be used for certain business purposes including:
- to assist in the development and marketing of our products
- to establish and maintain effective relationships with users of our products, including the App
- to respond to specific requests
- to manage, develop and improve our business and operations
In connection with these purposes, TrueTandem may disclose your personal information to TrueTandem’s employees, contractors, consultants, affiliates and other parties. When TrueTandem shares personal information with such parties, we require that they only use or disclose such personal information in a manner consistent with the use and disclosure provisions of this Privacy Policy and applicable laws and regulations.
Except as outlined in this Privacy Policy or any other TrueTandem publication addressing our collection, use, disclosure and processing of personal information, TrueTandem does not provide your personal information to third parties without your consent. Please note that, in special circumstances, we may need to share your personal information without obtaining your consent, such as when we believe in good faith that the law requires it, or to identify, contact or bring legal action against someone who may be violating TrueTandem’s or others’ rights or causing injury to or interfering with TrueTandem’s or others’ property.
We may also disclose information about you if required to do so by law, court order, subpoena or other legal process or we determine that disclosure is necessary or advisable for purposes of national security, law enforcement, or other issues of public importance.
2.2 Storing and Protecting Personal Information
TrueTandem maintains physical, technical and procedural safeguards designed to protect your personal information from loss and unauthorized access, copying, use, modification or disclosure. Unfortunately, no data transmission or data storage medium, whether electronic or physical, is impenetrable. As a result, we endeavor to protect your personal information, but we cannot warrant the security of any information you transmit or otherwise provide to us, and such provision of personal information is at your own risk. Once we receive your personal information, we make commercially reasonable efforts to maintain its security on our systems.
2.3 Data Retention
TrueTandem applies a general rule of keeping personal information only for as long as required to fulfill the purposes for which it was collected. However, in some circumstances we may retain personal information for longer periods of time. In specific circumstances we may also retain your personal information for longer periods of time so that we have an accurate record of your dealings with us in the event of any complaints or challenges. When we have no ongoing legitimate business need to retain your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will endeavor to securely store your personal information and isolate it from any further processing until deletion is possible.
Section 3. Third Party Websites
The App may contain links to third-party websites, including advertisements and external services, that are not affiliated with TrueTandem. Once you have used these links to leave the App, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from the App.
Section 4. What are your rights?
4.1 Fundamental Rights
You have the right to be informed of your personal data which TrueTandem has stored and processes, and you may at any time require that TrueTandem cease storing and processing your personal data.
4.2 Additional Rights
Depending on your state (or country) of residence, you may also have the right to:
- request that we update the personal data we hold about you and/or correct such data that you believe is inaccurate or incomplete
- restrict the way in which we use your personal data (e.g., if we have no legal right to keep using it) or limit our use of your personal data (e.g., if your personal data is inaccurate or unlawfully held)
- withdraw the consent you have given us to process your personal data (where we process your personal data on the basis of your consent)
- request that we delete the personal data we hold about you
- lodge a complaint with the data protection or privacy authority in your state (or country) of residence regarding our processing of your personal data
If you are interested in exercising one or more of the rights described above, you can contact our Director of Administration, Compliance & Security at shana.beatty@truetandem.com. Because we want to avoid taking action regarding your personal data at the direction of someone other than you, only you or an “Authorized Agent” permitted to act on your behalf may submit such a request. An “Authorized Agent” means a natural person or a business entity you have authorized to act on your behalf by providing your written permission. Please note, we may deny a request from an Authorized Agent if they do not submit proof that they have been authorized by you to act on your behalf.
Your request must provide sufficient information to allow us to verify that you are the person about whom we collected personal data, or an Authorized Agent, and describe your request with sufficient detail that allows us to properly understand, evaluate and respond to it. Please note that we may require proof of your identity before we can give effect to these rights.
We will not discriminate against you if you decide to exercise your rights under applicable law.
We cannot respond to your request or provide you with personal data if we cannot verify your identity or authority to make the request and confirm the personal data we maintain relates to you. To verify your identity, we will seek to match any personal data you provide when you (or an Authorized Agent) submit your request with respect to any personal data we already maintain.
